The Gabriola Island Local Trust Committee adopted a Bylaw Compliance and Enforcement Policy after amending it to limit enforcement on structures that predate 2008.[1]
For less serious contraventions, the policy says staff will generally proceed with enforcement only after receiving two written complaints from immediate neighbours; the minutes also record that staff may determine an investigation is required after one complaint, with the committee deciding whether it proceeds.[1]
The minutes say enforcement in environmentally sensitive areas and on matters related to health and safety will proceed if one complaint is received.[1]
Before the vote, Bylaw Compliance and Enforcement Manager Warren Dingman said the proposed 25-year threshold was intended to focus enforcement on newer structures, and that evidence such as statements from neighbours could help establish lawful non-conformity.[1]
The committee passed the amendment to limit enforcement on structures predating 2008, then adopted the policy as amended; both motions carried.[1]
