Mudge Island enforcement policy options to go to Gabriola trustees

A staff report on possible bylaw enforcement policies is to be sent to the Mudge Island Community Association before the Local Trust Committee’s November 2024 meeting.

The Gabriola Firestarter · Governance · 2024-09-12 · updated 2026-10-18 · Gabriola Island

The report will outline enforcement options and policies for the Gabriola Island Local Trust Committee to consider, after Bylaw Compliance and Enforcement Manager Warren Dingman reviews the policy for the Local Trust Area, which includes Gabriola and Mudge islands.[1]

At a special meeting on September 12, trustees said they had received suggested policy edits from the Mudge Island Community Association but had not decided how to incorporate them.[1]

Dingman said the Local Trust Committee cannot change Trust Council policies, but can adopt a policy for each Land Use Bylaw on how to deal with enforcement.[1]

The minutes record that Mudge Island residents described recent complaints as targeted and vexatious, with many speculative and veering into personal attacks.[1] The minutes also say staff will recommend how many complaints should be received before an investigation begins, and that proposed discretionary guidelines could consider the nature and urgency of a complaint, its impact, and whether it appears frivolous or vexatious.[1]

The association said deferring enforcement long term was not a solution, and that enforcement remained in effect for environmental health and safety issues.[1] Dingman was to send the staff report to the association before the November 2024 committee meeting.[1]
